ZBA Minutes APRIL 26 2012
The Zoning Board of Appeals of the Town of Avon held a meeting on Thursday, April 26, 2012 at the Avon Town Hall.  Present were Messrs. Ladouceur, Johansen, Ryan, Vicino, Ms. Hard and Mr. McCahill, Planning & Community Development Specialist.  Mr. Ladouceur called the meeting to order at 7:30 p.m.

PUBLIC HEARING                                                                      April 26, 2012

The Clerk read the call to meeting.

Mr. Ladouceur read the Application of Application of Dean Hamilton & Catherine Lewis, owners, Dean Hamilton applicant; requesting from the Avon Zoning Regulations, Section IV.A.6., a 10’ variance from the 25’ side yard setback requirement to permit a 16’x24’ shed located at 54 Lord Davis Lane in an RU-2A zone.  He was contacted by Dean Hamilton about two months ago to express he had a shed and didn’t know what to do.  I referred him to John McCahill.  Other than that there should be no conflict of interest.

Dean Hamilton was present.  He said he originally thought this was a zoning issue, not a ZBA issue and thought Brian could point me in the right direction which you did to John McCahill who was a great help.  The application is straight forward.  This is a workable location on the whole site and because of the way the neighborhood is set up.  He took the different zooms of the satellite photos to show the area is almost entirely wooded.  The neighbor to the south west would be the only one to see it.  The other abutting sites are not close enough, over hills and through forests which would block my house.  It’s as close to invisible as you can get.  The shed will be a barn red with a black shingle roof.  It’s as visibility transparent as possible.

There was no one else present.  The Public Hearing closed at 7:40 p.m.

Mr. Ladouceur read the Application of Marlene L. Chubb owner/applicant; requesting from the Avon Zoning Regulations, Section IV.A.6., a 15’ variance from the 60’ front yard setback requirement to permit a deck located at 4 Sylvan Street in an R-30 zone.

Marlene Chubb was present.  When she originally bought the house there was a garage in the front of the house and in disrepair.  She put on a two car garage.  The deck is going to be behind the garage.  There are trees and shrubs along the side and is the best place on the property.

Mr. Johansen questioned the zoning on the property because it’s on a corner lot.  
 
Mr. McCahill replied when you have a corner lot you have two front yard requirements and two side yards.  In this particular case they’re actual subject to a 40’ yard setback from Sylvan Street and a 60’ setback from Arch Road as it’s a collector road.  It’s really encumbered by a lot of building line setbacks for a small lot.  

Mr. Ladouceur stated the variance is for the 60’ front yard from Arch Road.  The deck is an odd configuration but is tucked in with the porch and not as close to the road as the shed that received a previous variance.

There was no one else present.  The Public Hearing closed at 7:48 p.m.

ZONING BOARD OF APPEALS MEETING                             April 26, 2012

A Zoning Board of Appeals meeting was held following the Public Hearing.

Ms. Hard made a motion to GRANT, seconded by Mr. Ladouceur the Application of Dean Hamilton & Catherine Lewis, owners, Dean Hamilton applicant; requesting from the Avon Zoning Regulations, Section IV.A.6., a 10’ variance from the 25’ side yard setback requirement to permit a 16’x24’ shed located at 54 Lord Davis Lane in an RU-2A zone.  The vote was unanimous by Messrs. Ladouceur, Johansen, Vicino, Ryan and Ms. Hard.

Reason – To grant variance is in harmony and keeping with the purpose and intent of the regulations and would not be injurious to the neighborhood.

Hardship – To deny would deprive the owner of a reasonable use of the property.

Mr. Johansen made a motion to GRANT, seconded by Mr. Vicino, the Application of Marlene L. Chubb owner/applicant; requesting from the Avon Zoning Regulations, Section IV.A.6., a 15’ variance from the 60’ front yard setback requirement to permit a deck located at 4 Sylvan Street in an R-30 zone.  The vote was unanimous by Messrs. Ladouceur, Johansen, Ryan, Vicino & Ms. Hard.
